Rose Cut Woes-Please help!! -New Update

Thanks everyone for your comments and suggestions. sorry if I miss anyone quesitions... I did buy this from a seller in the US, in fact in the same state as me. As to the credit card issue- I used my Visa check card but it doesn''t technically function like normal credit cards in this case- no protection because I authorized the payment to Paypal.

I actually just got a phone call from the seller''s husband yesterday- responding to a BBB complaint I filed against them, asking for a refund. He in formed me that tey would not be refunding me. During the course of the conversation, I found out that the primary reason for that is that they don''t have the money to give back to me. Yeah, and I''m just set after this whole ordeal!? Oh, yeah, he also suggested that I would have to just sell it myself now. Nice. I replied that I may have to do that, but obviously I would list it for what it truly is.

They did relist one of their items yesterday sans the ''malicious eBay troll out to get me when I prosper and wants my item for free'' part.

As to the ongoing saga, I''m not sure whether I want to try and sell this on eBay, although it now definitely has quite the story to accompany it, if I did.
 
New update: Well, I think I am going to try and list this on eBay. Hilarious, I know! I spoke with Patrick Davis (my appraiser) again and he thought Craigslist or eBay would be the best way to go, unless I want to go to a dealer. I'm not quite sure what category to list in, though, because the stone was represented to me as a rose cut and it's set in upside down to look like a rose cut even though it really isn't. Fortunately, it's actually worth about what we paid for it even though it was not even close to what was represented to me before I purchased it. Kind of like ordering a Lexus but receiving a Honda instead.
I'm kind of guessing that people who like antique rose cuts might like this,but I am totally unsure how to list it. Anyone have any great ideas, suggestions, or advice? I will definitely include the appraisal (with Patrick's permission) so that potential buyers will get all the facts straight this time. I want whoever buys it to be happy with it and know what they're getting.

I went back and forth on deciding whether or not to keep this, but in the end I just don't think I can live with the emotional baggage that's connected to it.

Dude, do NOT list it as a rose cut as that would be false information and since the psycho original seller is still on ebay, you dont want to say anything the slightest bit nebulous, you know what I mean?

Be totally upfront and honest. Tell the saga if you think it will help sell the ring. Make it funny as that''s the way these "Strange" ebay listings pick up speed. I''d probably list it under something like "X ct Antique Style Pear cut 3 stone ring" and then in the description explain that it''s set upside down and it gives the appearance of a rose cut, even though it isn''t a real rose cut. Take really good photos too and pay extra to list as many different photos as you can. And dont forget to provide a photo of the appraisal.

I would include any and all information from the appraisal that describes everything that you feel the potential buyer should know. Not that you would ''pull the wool over anyones eyes'', what was obviously done to you, you don''t want this ring to come back and haunt you yet again! I agree, tell your story and make it interesting! People really seem to love those fun listings! Mention that you are selling it because it no longer represents anything but a headache to you and your wife. Good luck to you!
 
To add to DD''s post...If you can dig up a link to that guy who sold his ex''s wedding dress on Ebay...that will give you a better idea of how to write up a sales pitch that gets attention. I wish I had an old link but I dont. Honesty, humility and humor! Hopefully that''ll do it for you! Oh, and when you DO sell this ring, you are SO NOT ALLOWED to buy anything else without asking us about it beforehand. I''m serious Mister!
 
Oh for sure-there is NO WAY I would list this in a deceptive way. Never in a million years. I would lose the entire amount of money on the ring before I would ever be dishonest in any way shape or form about it. I would never ever ever ever. I always took that as a given. I am going to list with it a scan of the complete appraisal as Patrick thought it was a good idea and we have his permission. Plus I will list a trillion pictures of every angle etc. with it. I will be very upfront and transparent about the sale of this. It was never a question of should I misrepresent this? I would never in a million years do that-I''m just trying to figure out the title etc. for a ring that is supposed to look like a rose cut but isn''t. Its kinda a wierd one to figure out a title and category for. I love you ideas!
 
And no way would I buy something diamondy without consulting all you guys and Patrick of course. I''ve been the village idiot of pricescope long enough!

By the way-the PS Moderator very helpfully emailed me to gently remind us to to careful with what we talk about as intended titles and such so we won''t be all gross and self promotional. I surely agree. And that surely wasn''t my intent. Just consider my posting as an update to an unfortunate chapter.

Let me qualify what I'm saying-- I'm a diamond-loving lurker, also occasional Ebayer, who happens to be a lawyer. I don't practice civil law, but I know enough to know you CAN and absolutely SHOULD sue them, for what's technically called rescission of contract, meaning you give back the ring, they give back your money, PLUS the cost of your attorney's fees at least... possibly the cost of the appraisal as well.

It was a tempting option that we looked into(we have a fabulous fabulous lawyer in the family). Our lawyer did contact them by mail. At this point we would rather take a hit than ever have to deal with them again. We have already been on the receiving end of a lot of nastiness. They have already slandered us and called our home. Even our lawyer feels that us dealing with them is bad news for us. At a gut level I feel like dealing with them more will cause us much more harm than help. We also reported them to the BBB and Ebay and Paypal which oddly found in their favor. The individual had represented herself as a business and jewelry designer later denied. But I certainly appreciate your point of view.

Oh and also to avoid the appearance or even what could seen as the tiniest wretched whiff of self promotion I will not talk about the listing itself anymore. I don''t need to be the village idiot of pricescope plus seem like the dude with the open jacket full of watches in an alley who''s all "wanna buy a watch". Not my goal. But I will update you guys as to the outcome for sure.
