oh no dkata...I'm feel frustrated for you! Cant you get the VAT back if you have to return something? How much is the VAT...wondering if JA
will eat it (probably not but ???) You deserve to get what you asked/payed for.

Edit...what country are you in dkata (if you dont mind posting). Sometimes other PSers from that country will respond with options you can take.

The VAT was 594,9 EUR , so about 700 USD!!! I don’t think JA is going to pay it to me!

I have researched a little bit, I may claim back the VAT, but it could take month to get it back.
 
Dkata, as a fellow european, I had my fair share of dealings with customs here. Here is what you can do. when you send back the item, you have to make an outbound customs clearance (to be done through customs broker) and claim the goods to be sent for "passive Veredlung". This will provide you the paperwork that would make it possible to receive item without any additional VAT once it re-enters EU. Make sure to have photos of the item and all the paperwork ready
 
Quick clarification - the only VAT charges in case of passive refinement are the charges for refinement itself, however in this case I would ecpect JA to do this for free

That is a lot of money! I hope you can find a way to get it back and have JA fix their mistake. Or maybe have JA unmount the stone and have
a setting made in Austria. You can be more hands on if you get it done locally.

As far as I know this part of customs regulation was harmonized over all major EU countries, so I am positive it should be applicable in Austria.
This way is a bit bothersome in relation to paperwork, but at least makes it possible for you to get the pendant you love

And do not let Fedex tell you that it is not applicable for physical persons (e.g. private person). While it is used by companies in 99+% cases, there is nothing in regulation that would imply that a private person cannot use it. It is just seldom.
 
I just wanted to give you some update. Finally I decided not to return the pendant, because I wouldn't like to have this hassle bevor Christmas. I'm going to keep it as it is. This is not how I wanted it to be, but at this moment I don't have the time and nerve to go it through with the return.

Tomorrow I'm going to make an own thread for the pendant with pictures.
