Yes I would file a police report today, Sunday.
Don't wait for tomorrow when the Jewelry Store talks you out of it.
I'm sure they don't want the attention but losing a $6000 diamond was their doing, and it is entirely appropriate that law enforcement is notified.
It doesn't mean you are prosecuting; it just means you have been responsible and informed the authorities in a timely manner.
If the store has done nothing tawdry they have nothing to fear.

Who knows? Perhaps this Jeweler has "lost'" many stones.
The police will know (but only if customers do the right thing and notify.)
Perhaps there is an employee who the police have information on.
This situation calls for transparency.
Secrecy can protect only a wrongdoer and will not be in your interest.

I'd go to the police department with the documentation and file a report today.
If nothing else it will send the signal to the Jeweler that they are not dealing with a push over, or someone who can be intimidated.

I hope this was an honest mistake.
But frankly, there may be a lot more than your diamond transaction at stake here.

I believe it would be the store filing a police report at this time if they believed the stone to have been stolen from them, not Brando. At this point they are trying to work with him to fix this in an equitable manner. Get the police and lawyers involved and who knows when or how it will be resolved. Be sure it will take longer and be less satisfactory.

The moment they quit trying to do the right thing will be plenty of time to call the police and hire an attorney. From every thing that has been said so far this does not look like it will be necessary. If the store does the right thing, it is totally unnecessary and unfair to put a permanent blot on their record at the police department.

In the meantime Brando can document everything and keep meticulous records to be turned over when and if necessary. He does not appear to be someone easily bullied or hoodwinked.

Oh no, I have to disagree about NOT calling the police.

Just because the store is trying to replace the stone in an equitable manner, does not mean the stone is NOT MISSING.

It doesn''t mean that there was a "Break in" or the store is trying to do anything wrong. The police report provides DOCUMENTATION that this occured, by a third party - required by insurance to make a claim (even if it is the store''s).

By no means is calling the police "involving attorneys"... or assigning blame at any point. It''s DOCUMENTATION of what is going on, and to provide a clear and quick result.

There is property missing that is worth a large sum. The only person "out" something so far is the customer. The customer needs to protect their rights, at the very least, by having it documented by a third party.

If everything is on the up and up at the store - they should never see this as a threat!
 
Trust me, if police come barging in and demanding this and that, and they will if they are anything like the police I know, it will be perceived as a threat.

The store is taking responsibility at this point and it is their decision if they think they just lost the stone or if it was stolen by an employee. If they suddenly renig on their responsibility then there is plenty of time to file a police report. At this point they have notified their client that the stone may be found over the weekend, it is not even definitely gone at this point. I just dissagree about getting in third and fourth parties before it is called for. But then I live in Idaho where we like to take care of things ourselves.

Well, I guess if the customer is out a few thousand dollars it doesn''t matter.
 
You can always call the police. I would save that measure for if and when it is really needed.

At this point it sounds like the store is being cooperative and really trying to make right. I would advise giving them a chance before resorting to sledgehammer techniques.
 
Another reason to inform the police:
If it was stolen chance of identifying the offender and recovery of goods goes down the longer you wait.
The trail cools.

Also, do you really think the store would tell you if they suspected employee theft?
 
They do seem sincere about locating and/or replacing the stone and I will give them the chance with this one they offered. After speaking to John this morning I'm going to insist that they send it to an appraiser of MY choosing who can give me the same information I had on the diamond from WF. If the diamond is acceptable I will go ahead and finish the deal and be happy I got an upgrade (but I would be much happier if the one that I picked out was found over the weekend).

I also agree that getting police involved prematurely is just going to gum up the works and slow everything down, get people defensive, and make more problems than necessary at this point. I'm not quite ready to call in the police yet. I believe they are acting in good faith and tomorrow I will request a letter stating what happened and what they are offering for my records. From there it's to the appraiser (John recommended several Pricescope appraisers and specifically Neil Beaty who is closest to me in Colordao. I will be trying to contact him tomorrow) for a final analysis and decision. If I don't like the diamond I'll either have them write me a check or work with them through whiteflash for another diamond at their expense.

The other consideration is my girlfriend. Let's not forget she's already anxious to get engaged and this could turn into a massive delay that I do not want. I'll have to tell her everything if things get slowed down on this and I have worked really hard to surprise her, another reason not to involve other parties until I have no other choice.
 
Brando you have taken many things into account in a stressful situation, and have a wise plan.
I'm sure this is going to work out for you, and make your girl the happiest in the world.

At least he heard many ideas and made a very informed decision.

It is all about what feels right to the customer.

Alright just an update.

The diamond is nowhere to be found. They had it with the setting they were making when I called on Wednesday about it. They said the setting wasn't done to their satisfaction and were going to have it remade. The person creating the setting said he didn't need the diamond any longer because he had the measurements now. Flash forward a day or two and the second setting comes back, they like it and nobody seems to know where the diamond went. The jewler thought the person doing the setting had it and he thought she had it. After that they've both been tearing their areas apart looking for it, no luck though.

Despite many people's suggestions I'm going to give them a shot with this other diamond. They are really sincere in their efforts to make amends here. I called this morning and the Jeweler actually sent it to a local appraiser in LA already. I had to call and talk to that appraiser and found that he didn't have the same tools or scopes that Whiteflash used on the original so I asked him to hold on that appraisal and called the jeweler back. She quickly agreed to send it to Neil in Colorado for me. If it passes mustard, fine I'm ok with taking it. If not then we'll be working with Whiteflash.

I actually feel really bad for the Jeweler she was almost crying on the phone with me. She said she has lost a lot of sleep the past few days over this and that in 30 years nothing like this has ever happened to her. She also said that they will never take responsibility for an outside diamond again, which made me feel kinda funny. I hate to be the one responsible for others not being able to use their services but understand it's their business decision. She says that this other diamond is her favorite and the prettiest she has in the store so if she's being totally honest it should have a great appraisal. If not, well, It's back to whiteflash, the time to research and select another diamond isn't something I look forward to. I wanted to propose in a week or two and it looks like it might be more like next month.

I am so sorry to hear that the diamond is gone. I am glad you feel the jeweler is sincere in her efforts to help you and relieved to hear that you are having their proposed replacement sent to one of the trusted PS appraisers who has the tools of the trade. Be sure to send Neil the ideal-scope image, sarin, grading report and photo of the original Whiteflash diamond so he can make as much comparison as possible. If you like I can forward those to him, just let me know.

As was said above, this needs to feel right to you. I am hoping all goes well with the jeweler's proposed replacement. If not, we will do everything possible to help you quickly. As before, I am at your service if you would like further input.
 
Brando, it sounds like you have this situration under control but I just wanted to add my two cents. You''re definitely doing the right thing using an outside appraiser, selected by you, not the jewelry store. I have no doubt that the jewelry store owner is sincerely upset about what happened, but keep in mind that, in addition to looking bad to you, she''s also may be out 5-6K (unless insurance covers it, but then her rates go up for the claim, etc...) so just because she''s upset, doesn''t mean that the replacement stone is all she says it is. I''ve NEVER spoken with a jeweler who didn''t tell me that their diamonds were the best cut out there, yadda, yadda, yadda. If Neil''s appraisal does not come back saying the stone is the same cut quality of your last diamond, PLEASE don''t just take it anyway it because you''re in a rush or you feel sorry for the jeweler, or bacause she says it''s her favorite stone. Your future wife will wear this diamond for the rest of her life so a little delay, even an inconvenient one, is worth the wait.
 
No worries there Groom. I'm already more inclined to go back to Whiteflash and am just giving the jeweler one chance on this diamond. If it's not all the previous diamond was or better, no if's and's or buts, I'm not taking it. After our last conversation the Jeweler better understand that what is written on a GIA cert doesn't mean the same or better to me. Something most of the jewelers I've met have trouble understanding. They all act like the GIA says all there is to know about the diamond and that equally rated GIA certs means an equal diamond.

Being empathetic is one thing, letting them take advantage of me is quite another.

When will you be seeing the replacement stone in person?
If you end up with this one will it bother you? WF has very lovely stones and you spent time and effort picking out just the right one for your soon to be, will it bother you that you did not choose this one? I am not trying to make you nervous just thinking about things that might come up down the line.

If the diamond is as good or better than the one I had before, I''ll have no problem with it. Whiteflash was great and I''d use them again in a heartbeat but If the diamond is already awesome and includes some upgrades, I don''t need to spend more time searching. The only thing I''d miss is the WF buyback policy which is a nonissue for me because my girlfriend would never in a million years let me trade in the diamond I proposed to her with.
 
Brando, just want to chime in to say that I admire the way you have handled the situation. Bodes well for a successful relationship you are about to enter into!

I hope things go well w/ that replacement diamond. I like how you handled things as well. It''s stories like this that make people real hesitant to shop at the diamond district for high quality stuff. I love my jeweler, but he, like the others, doesn''t "teach" that much. Seems like they all say their stuff is the best or as good as any others and it''s up to you to point out all the factors that need to be considered. I only like my jeweler cuz he''s real low pressure (unlike most others there) and while he never offers up any info that I need to consider (other than the 4 basic C''s), he''s been knowledgeable and honest as he could in his answers.

I''ve been reading with interest your situation. I''m sorry for this mess that Rondels put you in, but I''m very impressed with your handling of the matter. I''m also impressed with Rondels acceptance of ownership for the problem (rather than passing the buck) and their willingness to make it right. I''m extremely impressed with their agreeing to send the diamond off to Neil. Granted, they need to do whatever they can to make the situation right, but they could''ve made it difficult for you. It sounds like they want you to be a satisfied customer in the end.

Well I received the appraisal from Neil last night and was able to talk with him this morning. Seems like the replacement diamond is a winner so I''m going to go ahead and take it. According to Neil there''s a little less light return but it has more scintillation. Based on his appraisal and opinnion I''m going to accept the offer. I have a few pics but they''re inside the appraisal and I don''t know how to pull them out to post here. Maybe Neil can do that.
