Who Oh Harriet...

We must! There''s a possibility that we''ll go to Aviara instead. Is that still near you?

Gargamel scared me as a child. Heck, Papa Smurf did too.
Not far. 30 minutes or so...Depending on San Diego traffic. I''d be happy to make the trek!

Gargamel was/is creepy to be sure. His cat, though, I feel, was just misunderstood. With love and proper attention he could''ve been a very nice kitty. I hate it when good cats go bad!

Sounds good either way. Which area is prettier? Yay! We''re meeting!

I think they are both beautiful. It depends what you want to do while you are there. San Diego traffic can be INSANE. It is such a beautiful place, but, it drives me nuts to drive around. It took DH three hours to drive 40 miles last week.

How long will you be out?

Here are a few OC resorts, if you haven''t looked into them. Pelican Hill just opened. It''s a great place to golf if your hubby is into that.

That would be fun....

But I have a professional question first...and I will provide the disclaimer for you.
31.gif
disclaimer for Harriet: This is not intended to be legal advice, so don't even go there....

So why is it that nuisance settlements made to to former employers are not always treated similiarly?

I am not talking about severence, or actual settlements that are designated as back pay etc. which are clearly payroll. I am talking about the random crazy that wants to get creative and file a claim for misappropriation of likeness or some other equally meritless claim and the company decides to pay them $3000 rather than deal with a possible cost of defending a suit. Some treat it as payroll, others as a "other income" and 1099 it. IRC 3402 isn't helping at all, and I can't find a consistent answer. Physical injury settlements are a no-brainer, but these others.... 104 is not specific to smaller informal settlements.

Is that because there isn't a consistent answer or guide for an employer? There sure is a guide for the taypayer on a 1040, so it's clearly intended to be reportable. Thoughts?

We''ll be staying for 5 nights. But, the husband is flip-flopping. He had me on the phone with the travel agent for 3 hours to discuss possibilities in Miami. Help!

I can''t give you a legal answer because I''ve not dealt with employment law nor its tax consequences. Sorry. Why don''t you post it on Hangout?

haha - I see how it is. You get to do the grunt work! It''s the same way around here! Hubby says, "Let''s go skiing." Then I''m stuck finding suitable houses or condos and activities for the kids! Ah well, I''m not complaining. There are worse problems to have!
28.gif

Why don''t you go wherever the weather will be better! It is 44 degrees and raining today! BAH! It''s coooooold. This is Southern California! We celebrate Christmas in shorts for goodness sake! What''s up with this weather? I''m not trying to discourage you from coming because I''d love to meet you! I''m sure it will be warm again soon. Last week I was at the beach with the kids in the warm sun! I''ll have to get the weather report from my meterologist son!

Boo....oh well....I was able to figure out the best practice for employers.

What area of tax law is your specialty? Do you know anything about ESOP''s?
31.gif

I can''t believe that Southern California drivers still can''t figure out how to drive safely in the rain. We get a rainstorm and BOOM, our city has 300 auto accidents in a day.
38.gif
Unbelievable....

I think so too. We''ll meet some other time, right?

Great!

Financial instruments and, believe it or not, insurance. Unfortunately, I don''t know anything about ESOPs.

What?! It''s just rain, not ice or snow.

Ooh, I love trifle. How was dinner?
Dinner was good! James was really pleased with it, and for the rest of the night he kept kissing me and saying, "Dinner was absolutely delicious, thanks again, babe!" You''d have thought I usually let him starve or something.
3.gif

It''s not too personal at all. Do stop apologising. I''ve been away from my family for a while. I''m an only child and my parents are not very close to the extended family, so it hasn''t been too difficult. I chat with my mum and dad several times a week. I feel that we get along better with the distance. I didn''t make any conscious decision about a permanent move. Good luck with whatever decision you make and may it make you happy!
Ok, ok, I''ll stop apologizing! I''m just aware that lots of times people don''t want to share too much information, that''s all. But I''ll go on and barrel ahead and ask you whatever I want because you told me to, right?
3.gif

Anyway, I was just hoping your insights could help me make this decision. I think my mother and I get along better with some distance, but I would also like to see her and my dad (and brothers and friends) more often than I do now. If we moved back to the US, we''d probably settle in Maryland or Massachusetts, both of which would be about a 4-hour drive from where my parents now live. So, we''d still have a good amount of distance, but not too much... But then James would have to live a few thousand miles away from his family and friends, and I know he''d rather stay here in England. I wish I knew how to decide!

So...yeah. That''s more than enough about me! So, when you go away for the holidays, will it be a trip for travel, rather than to meet up with people you know? Will you have to fly or could you go by car? A friend of mine from work is going to Egypt for Christmas because all she wants is a week in the sun... I told her to sign me up.

Here is my gemstone / jewelry tree. The "lights" are a necklace, the star on top is a pen and the ornaments are out of my gem dish. Notice one little guy rolled off already but I didn''t notice it until I''d downloaded my pictures. Rats.

Absolutely.

It sounds like James and you need a good talk because on one of you will have to make some sacrifice. At least London's not far from the East Coast.

I'm leaving on Christmas Day (cheapest tickets) to my happy place -- Miami Beach! Sun, oh sun, please!

Btw, there's a strong chance that I'll be in London in April.

I didn''t find anything worth paying for. I did find a hotel, so we''ll look when we''re there. These few days, I''d pay to get him off my hands.

I am glad I was able to give you a laugh. What is your lovely new avatar? Have a blast in Miami. Enjoy the warm weather for me.

Paraiba would have been my guess - it''s lovely and I can see why you are lusting over it. I loved your Marshmellow Man though. We are not going anywhere warm - rats. Well, my parents keep there house near 75 and so it''s kind of warm in there but it''s only down the street. We''ve been in the single digits with sub zero wind chill here. You''d think it was winter or something.

No, it''s true, it isn''t far (relatively speaking). And James and I have had a few talks and he always says the same thing--that he''ll live anywhere in the world as long as he can be with me. Which is lovely of him, but it leaves the decision up to me (which is good but a huge responsibility). I know his preference would be to stay here because he loves England so much and he would miss it a great deal if we left. But of course, I miss my family and friends back home a great deal, and would enjoy not paying quite so much money for everything here, so...yeah. It''s tricky.

I''m leaving on Christmas Day (cheapest tickets) to my happy place -- Miami Beach! Sun, oh sun, please!
Oooh, that sounds like heaven!! I hope you have an amazing time and take some photos of the water and beaches for me so I can imagine myself in the warm sun! (Haven''t seen the sun for a while here.

Oooh, really?! How fantastic! I might be away for part of April as I''m hoping to use my Easter holiday to fly back home but let me know when you might be here and for how long! How fun would that be!!
9.gif

And in case I don''t get another chance, merry Christmas and a happy new year to you, my dear!! James and I are off tomorrow for Yorkshire so I may not have another chance to say it. Have a safe and wonderful trip!
35.gif

Hey Gwen,

Did you have a good time in Yorkshire?

Yes, anything goes. ;)

I understand how difficult it is to be the "decider." On the other hand, James sounds like a dear.

I believe I have to be in London before April 10. I''ll check and let you know.

Haha! Me? Pictures?

Merry Christmas and a Happy New Year, dear friend!

Harriet, I just caught your message in the gift thread about meeting up while I was in town, we returned home yesterday and I''m so disappointed that I missed the chance to meet you. We''re talking about heading back your way again this spring, will most definitely make sure we have the opportunity to get together.

We spent a bit of time in jewelers row while there, I was actually brave enough to go into a place and look at diamonds (only because while window shopping the store owner wrote "Come in we''re friendly!" on a slip of paper). It was quite a wonderful trip filled with good food and great shows.

Too bad you''re not coming to San Diego, we could meet here!

K

Aw, it is a pity. I''m glad you had a good time though. I''ll be heading west next month and am contemplatin going to Southern CA as well.
