Benari's is trying to steal my money!!!!!!!

So I had put a refundable deposit down for a verragio setting and stone. It was around $1300. The jeweler at Benari's told me it was 100% refundable and there was a sale happening on June 20th for it and I'd be able to get the sale price if I put the money up on that day. I called to get the sale price I liked it, I asked if I change my mind can I get a full refund, He said yes.
So i put a total of 5k on my credit card. I told him I need to talk to him before we go any further about customization of the ring for sizing and maybe a different stone. He said no problem we'll talk on Tuesday.

Today I call first thing and told him I'd like to cancel the order completely, he tried to save the sale I kindly told him he was wonderful but I'm going a different direction and I appreciate his time. He said I would receive a full refund within 2 days off my credit card. He calls me right before the store closes and leaves me a voicemail to call him back. I call him and he says Veraggio already made the ring and now I own it. I go, wait I have no ring, I never authorized that, you never said you placed the order, and you just told me I'd get a full refund. He says they custom make it so I now own it. I asked to speak to a manager, he dodged and said he call me tomorrow. I have already called my credit card company and have placed a dispute.

I'm really worried because they'd try to charge me 3.3k for just the setting that I no longer want, don't have and never asked them to make it because I was going to customize some things if I was going to get it.
 
I will be calling them first thing tomorrow at 10am
 
Call your credit card company and tell them about this. They should file a dispute with the vendor.

yea i did that the moment I hung up the phone. I don't see how I'm responsible for them not following what I asked and ordering a setting I did not say to, and not warning me. Also I am within 15 days.
 
You never authorized an order, nor did you sign anything. Definitely proceed with a dispute.
 
Did they even know the ring size? You paid $5000 on June 20th and have not spoken to them again until today, June 30th? I am not understanding why you paid the $5000 when you already had a deposit down and were still uncertain. I feel like there has to be more to this as it just doesn't make sense if nothing was ever written up yet you paid $5000.

There has to be something more to this. Where did the $5000 amount come from? I don't know how a final price of $5,000 was set if you were going to be customizing a stock setting. I would think you would have had to discuss customization and the costs that would be involved with it before the final price was set.

Or did you agree on a final design for $5,000 and now want to utilize some sort of return policy?

Were the customizations ever discussed between the 20th and 30th or is $5,000 the sale price of the stock setting?

I can't believe they would have just gone ahead and had the ring made despite you saying you wanted to make adjustments to it, and if they did, I would be livid and would absolutely dispute the charge.
 
It seems like the $5K came from a sale. OP said if he put up the $5K he'd get the sale price for the setting that was happening on June 20th. So if I'm understanding correctly, he paid the $1300 deposit plus an additional $3700 to secure the June 20th sale price on the setting. He does state that he made sure that despite putting down more money to secure the sale price, he'd still be able to cancel and get a 100% refund. That's what I gleaned from his post anyway :confused: .

that is 100% correct
 
spoke to the vp of operations, he apologized about the misunderstand and will be giving a full refund.
 
Glad to see that they kept their word.
