Octavia cut in coloured stones in NZ

There is someone else using Octavia but for diamonds, although similarly, the cut is not the same:

I never filed for trademark protection because it never did really take off, I could claim trademark by usage but its a weaker case and probably doesn't apply international.

Is there a cost involved? I'm guessing it's one of those things that the man in the street struggles to protect their IP because they can't afford to assert control over it, whereas giant faceless corporations with very expensive lawyers can screw the little people as much as they want
