Kay Nightmare Continues

Well, Kay refuses to talk to me although I’ve been promised a phone call from a manager. I’ve gotten two emails, one telling me that now they might dispute that the ring was a Kay item, thus I might not get a refund. The ring has been sent back, so how will I ever prove it was a Kay piece? The order info says it’s a Neil Lane, and I returned a very NOT NL piece. So they could easily say it’s not even theirs I’m trying to return.
What do I do? I’m seriously considering calling an investigative reporter that has done many stories on Kay fraud. But I hate to be that loud public person.
 
I assume you have a receipt showing your bought the ring at Kay Jewelers.
 
The paper receipt was sent back with the ring. But the receipt says it’s a Neil Lane even though it’s not. I can still access the receipt online.

You need to be that loud, public person. I, honestly, am not surprised. As much as it saddens me, I’m not. I don’t shop at Kay, but we have shopped at Jared. Quite frankly, it’s incidents like yours, with Kay’s, that conglomerates all of these stores into a heap of fraudulent practicing hoodwinkers, which, in reality, isn’t always the case. It’s best to judge jewelers & stores on an individual basis. I can say that I have SPOKEN to several different customer service reps at different Kay’s stores around my area, and each of them rubbed me the wrong way, and had an air about them that just didn’t sit right with me. Comparison shopping also taught me that Kay’s is a rip off, and their mark up is quite significant compared to other stores that carry the same designers/product.
If Kay’s plays the “this isn’t even a Kay’s product” game with you, you need to bring them to their knees. Do you have a confirmed transaction from Kay’s? Any receipt via email or some sort of proof you bought this ring from Kay’s? I can’t imagine you don’t have proof of purchase. You need to nail these charlatains to the wall, if they deny you a refund....

You have the confirmation # with the info attached to the item. I’d LOVE to see them dispute it!
 
I'm just stunned at the audacity of Kay. Every time I hear one of these stories, I can't understand how they stay in business. Call an investigative reporter. You have the proof including photos from the ring when it arrived. They can try to rebut all they like, but they are just trying to wear you down since you know they were scamming you. Stay strong and don't put up with their bull.
 
The pictures matches the Neil Lane ring on the website. It's irrelevant to the return that the NL mark isn't in the ring. That's what they sent you. I would not escalate yet. If you are in communication with them, I'd just say that you bought a second ring and it didn't match the first so you don't want it. You have the receipt showing you bought it and the ring matches the design on their site. If they don't process your refund immediately. then you will be contacting an investigative reporter and your attorney. Do that and give them the chance to complete the refund. I'd ask for a supervisor and not just a customer service rep.

Just to be clear ~ you returned the exact, unaltered item you received, correct? If that is the case and I believe that it is, you will receive your refund ~ I wouldn't worry about it.

The concern is that because she didn't receive what she ordered (she ordered a Neil Lane band) and instead was shipped a knock off that looked the same but was likely a fake, Kay is now saying that maybe she will not get her refund because she isn't returning what her receipt says she bought (which is Neil Lane band). As in.....Kay is possibly suggesting that she did get the Neil Lane band since that's what's on her receipt but is returning a fake that she got from somewhere else so that she can get money back. Confused yet, lol?

Definitely talk with a supervisor or manager and be firm. I'm so sorry you're having to deal with this :x2.

They stay in business for the same reason that any other shady company stays in business. The average consumer won't do research ahead of time before purchasing from a company, and therefore has no idea what kind of hell they're getting themselves into. Once the company screws them over, they'll either:

!.) Not even notice that they were screwed over and given a fake ring and/or diamond OR
2.) Not have the guts to try and stand up to the bully tactics of the company.

I agree with everyone else. Nail them to the wall. Raise all kinds of hell until you get the product you deserve or a refund. You have proof of purchase, so they're pretty much screwed here. If they claim it's not a Kay item, then have them send it back to you. Take the (obviously fake) NL ring to a lawyer with your proof of purchase from Kay stating that you bought an NL ring. This is low hanging fruit for claims court.

Even if you nail them though, they'll keep doing the same thing. They make a high enough profit margin off of the other suckers who will never pursue retribution that the few people who they have to pay out to really don't make a difference. Sad the way modern business practices work sometimes. :(2

As I was reading through this new update I was getting anxious for the same reason. I was worried Kay would accuse the OP of doing a bait and switch.

However, there must be some reasonable way to prove that isn't the case. I'm guessing because the OP raised the issue soon after receiving the item, it appears legitimate?

I love reading PSer's comments as they try to help a fellow PSer! It's pretty awesome watching everyone rally to someonoe's aid!

I'm hoping you find a satisfactory resolution!
 
I wonder if you could also email Neil Lane and file a complaint with them since their vendor is not shipping fraudulent products under the NL logo
 
Unfortunately, the OP is absolutely right to be worried. She has no proof whatsoever that she is returning the item that she received. No, Kay´s has no proof either that she switched the item but sadly it is up to them whether they issue a refund. If it was me, I would escalate pretty quickly if they do not admit it. It is up to the customer service of a company whether they take back such items. When it concerns a company that is sending out knock off-s, I do not have much faith in them honoring a return in such cases. The only proof would be if there was a tag attached to the item, undamaged, with the exact item No that is on the receipt and the website. In the absence of such, no proof exists. I would go out of my way to make sure word gets out about this, it is blatant fraud, misrepresentation... so sorry OP.
