Working with pre-Kimberly process rough diamonds (pre-2003)

Our company is interested in a small parcel of rough diamonds, but the parcel does not have a Kimberly certificate because it was acquired by the seller prior to 2000. It comes with an invoice/guarantee that the stones are from a legitimate source. In your opinions/experiences, would that become an issue when the stones are shipped from Antwerp to New York? Or should we just have them cut in Antwerp? Thank you in advance for your input!

If the seller is a registered diamond-company in a Kimberley-compliant country, there is no such thing as rough diamonds being pre-KP and thus without certificate.

At the start of the KP, every registered diamond-company had to report its existing stock of rough diamonds, which thus became Kimberley-compliant. If the seller failed to do that, these rough diamonds are not Kimberley-compliant. If he did, there is no issue.

If the seller is not a registered diamond-company in a Kimberley-compliant country, tough luck.

The seller is not a registered diamond-company. They are a small, independent European retailer/wholesaler.

In which case they probably need to register themselves with their local Kimberley-authority, in order to regulate their so-called pre-KP-inventory. I have no idea on how complicated that process is, but unless they do, their inventory is illegal in nature, and there will not be a possibility to export it. They will definitely have to provide proof to their KP-authority showing the origin of these goods being absolutely non-conflict and pre-KP.
