Tacori Ring Re-sizing (Problems)

I recently ordered a new Tacori engagement ring (HT 2329). I noticed the jeweler had the ring in the store (size 5.5), so I specifcally asked they order a new ring for me and not resize the one the had in stock. 6 weeks later, after "pretending" to order a new ring, I got the ring, and it looked resized. The band was uneven and you could clearly see marks not typical of Tacori.

As a result, I called the jeweler and he mentioned that there was a mix-up and it was re-sized in his store. He said he would send the ring back to Tacori to have them "refurbish it". A few questions after reading other posts on similar problems:

1.) Should the ring AND diamond (which is already set) be sent back to Tacori?
2.) Are there issues with a refurbished ring? Or should I demand he order a brand new custom ring as originally purchased?
3.) While the ring is being shipped to Tacori, what kind of receipt should I request from the jeweler? What happens if they lose it?

Personally, I work hard for my money and Tacori ain''t cheap. I would demand a NEW ring, sized BY TACORI, with the diamond reset at THEIR dime. You already fulfilled your end of the bargain by paying for the ring, they screwed up and didn''t fulfill theirs! I wouldn''t take any exceptions and I would NOT take a "refurbished" ring for full price. Nuh-uh!

If I purchased a new, custom ring, I would not settle for something less than that.

I would not want to do further business with someone who misrepresented (honestly, LIED) about what I was given until confronted about it. You should have been told if there was indeed a mix up and given the option of (a) having the store ring resized or (b) waiting for the order to be placed again. That leads me to believe their intention was always to deceive you. I hope that was not the case.

I would have a long hard 'chat' with this store because honestly, I'd want my money back. Who's to say you can trust them now? I would not settle for a refurbished ring because the store didn't order the one you asked for in the appropriate size, as originally agreed upon. It's up to you as to whether you deal with them to get the original ring in the right size, as you asked. They owe you that, or I'd get my $ back. And be wary of how it looks when the 'new' ring comes back, if you go this route.

Thanks all for your suggestions. I''ll be meeting with the jeweler on Wednesday and make clear my demands, new ring or refund. I''ll upload pics when all this is done..
 
Get 100% of your money back & report them to the Better Business Bureau. What they''ve done is outright FRAUD (in my opinion).

I wouldn''t give them the sale of the DIAMOND or the RING at this point. And tell everyone you know what they did. Including the local NEWS CHANNELS.
