GST and duty in Australia for resized ring from USA

Hi,

PSers from Australia, please share experience.

I bought my wedding band in USA and it was shipped here in Australia. We paid the GST only as it was duty exempt when it arrived here in Australia. I got this one problem. When we went overseas in Asia, my wedding band was so tight on my finger and so I contacted the vendor that I would like my ring resized. I prefer to have it resize with the vendor as the design is a bit complex. It has uniformly distributed stripes around the ring. The orientation of the stripes is perpendicular to the edge of the ring.

My question is, do I need to pay again the GST and duty for the same item after its resizing in the US? The item will be returns here in australia by fedex after the repair. I contacted fedex but
No response yet.

Any similar situation?
 
Just to add the route. The item is in Australia then to be sent to the US then back to Australia.

What so you mean 'just add the route'? So fedex put this on the paperwork or how does this work.

I have the same issue, and am not looking forward to paying gst again. It will also be returning via fedex.

Any clarification will be appreciated.

I don't have any experience with this but I'd suggest you call customs and ask them what the process is. Because it is just a repair you shouldn't have to pay again, but you will probably have to fill out some paperwork.

I am not the original poster, but I believe this may qualify for a duty concession.

Subsection 42-5(1) in the GST Act, in conjunction with paragraph 13-10(a), provides for an exemption for goods that qualify for customs duty concessions.

In your instance, you may be able to seek exemption, if Customs consider your works to be either:

- Goods, or parts of goods, previously imported into Australia and returned after repair overseas free of charge in accordance with the provision of a warranty applicable to the previously imported goods (under item 18A)
- Goods, or parts of goods, supplied free of charge under the provisions of a warranty to replace goods or parts of goods previously imported into Australia (under item 18B).

I would speak to a customs broker about how to go about obtaining those exemptions. It may involve making a declaration before the goods are exported, or proving that duty has been paid on the unrepaired goods. Maybe others will be able to provide more guidance.

Again, I have no experience in this area, just wanting to help out a fellow Aussie! Please also report back!

Gwaipor are you able to let us know what additional research you have done since your last post? It may make it easier for us to help you, and also provides information for others that come here looking for answers. Have you tried calling Australian Customs or a customs broker directly? I'm not sure what additional information we can give you without you firstly providing us more information.
