Bergdahl does not stand convicted of treason; indeed, he wasn't even charged with treason. As noted in the article you linked, Bergdahl was charged with, and pleaded guilty to, desertion & "misbehavior before the enemy." Neither of these Military Justice Code offenses is punishable by death.
