How did people know it was her? The video is not very clear at all ...
 
Who knows, but I'll be sure to put my hair back in a pony tail before falling into my local mall fountain. ;)
 
I think this is hilarious. Yeah, it's embarrassing and I probably would be mortified if it were me. But, I would also realize that I wasn't watching where I was going. Completely HER fault!!! This will get laughed right out of court. What were the security guards supposed to do? Escort her through the mall so she could text and walk safely? Come on.

I forgot where I read this, so maybe I'm wrong- I read that an acquaintance called her to say he saw the video on youtube and recognized her walk . :confused: My impression was that pretty much nobody actually knew it was her until she made a fuss and identified herself.
 
If I were the judge in this case, I would slap a fine on the attorney taking on this idiotic case :rolleyes:
 
Ohhh Gawd. As the Eagles song goes, Get Over It. Duh. Seriously. Had that been ME I'd be on TV going "Omg, lookit get ready ohhh boom there I go! haha let's watch it again ohhh splash! dang what a dork I am!" And I'd giggle and clap my hands like a kid. It's funny, have a sense of humor lady.

Is she suing:
the mall, for putting the fountain there?
her phone company?
the person she was texting for existing?
the maker of the phone for not including a proximity radar feature with a dumb-sh!t alarm?
Issac Newton for discovering gravity?
her parents for low IQ genes?

Whom could be she be possibly suing for this?
Perhaps she's suing herself.

I agree, stupid of her to text while walking, and she's exacerbating her own embarrassment by suing over this, but over...

What mall or security person would be stupid enough to post that video on youtube in the first place? It was recorded on security cameras that are in place so the mall management can - duh - identify and prevent security and theft risks. It isn't there for entertainment. One of the indoor malls that I frequent is very public about their security... during the holidays, especially, I can count on a "news" story about their heightened security, which includes an extensive array of cameras, security personnel watching parking areas from the roof, and even parking unlocked "bait" vehicles in the lot to snare bad guys. So... when I go into that mall, I understand that being recorded by video equipment is part of a my part of the bargain for the right to shop there. The mall's part of the bargain is that they'll use those images only for security purposes. If the mall released some of those images of me *for entertainment purposes* I'd be royally p*ssed too.
 
Hmmm...not sure I think it's appropriate to post the surveillance footage on youtube. That is why she's suing. I can't say I would sue too, but the person who did this is a jerk.

Yes of course, she probably wants to sue because they released the embarrassing video of her. Duh, Kenny.

I think when you enter private property, like a store or mall, you give up some of your privacy rights.
If you don't want to give them up you don't have to enter the private property.

It will be interesting to see if security can be sued for this.

Yeah, I don't get it. This woman was on Good Morning America last week and she looked distraught. Embarrassed, sure. Distraught? Seemed a bit dramatic. I do think it would have been nice for someone, anyone, to go over to the woman and make sure she was okay though.
 
I was at the mall the other day and started watching people just to see how many people had some sort of gadget. I swear, it was about 25% (very informal observation as I walked) that had SOMETHING in their hand, even while walking and talking to someone else. And a goodly portion of them were walking and texting, head down, not seeing anything around them.

Given how many times at work, that I've nearly been run down by someone walking while having their head up a "smart"phone, I have to say that there is a HUGE downside to these things. I loathe them for that reason, and a few others. For example, my husband has a sailboat, and a crew for said boat. One night after a race, we were all sitting around - in a close space with various people - waiting for the hotdogs to cook, and all 5 of his crewmembers had their heads down, texting, not talking to any of the real people around them. I said, rather loudly, and just a trifle amused, "Well, here we see the generational difference in action." They all jerked up rather sheepishly and contritely, put them away and started chatting with the people there. They KNEW it was rude, but almost couldn't help it. It's like an addiction.

That women is clearly as self-absorbed and entitled when NOT texting as she was while doing it. To sue? Give me a break. I hope the judge fines her big time for wasting the court's time.
 
What kind of lawyer would even take this case? So she's embarrassed herself...she needs to get over it because she can't sue due to her own decision to text while walking... or can she? (seriously I am not a lawyer - is that even possible lol?)
 
I think the problem is she revealed herself associated as the person in video and now she wants what? $$ :$$): for "emotional damages?" :rolleyes: for her lack of common sense to look ahead while walking instead of texting?

Would this have been a different case if it was some random stranger who caught this on their camera phone? vs on a security feed?

A bit. It would be like the difference between a random person posting a "What NOT to Wear - EVER!" video using video they shot at the mall, versus some mall cop posting the same thing using security footage. Or TSA, for that matter. We all understand that going through security screening is part of the contract if we want to get on that air plane. Does that give some airport security hack the right to post images caught by that security system on youtube for yucks?

But it still would not have been an issue if she had not identified herself by filing the lawsuit... it'll be interesting to see how this plays out.

Yeah, it's pretty bad with people walking texting. I wasn't sure about posting another story because it's a tad morbid. A teenage girl was walking down the street while texting and she fell down a man hole and died. What a way to go, huh?
