Sorry if I missed this in your posts but are you getting married in MA or CA?

I think I read in one of your posts something about a 30 day waiting period? Is that for CA?

I''m asking because my cousin is coming out for my wedding in October from Indiana. He and his FI will be getting married the day after me in Carmel, CA. We''re going to hold a beach ceremony for them. I told him he just needs to go get a license at the court house in that county (he''ll be there 2 days before). I''m not sure if there''s other restrictions though. I figured since you''d looked into it you may know. They aren''t CA resident so I''m not sure what the restrictions are if any...

We''re having the ceremony in MA, but getting the license in CA depending on the legality status in June 2009. :)

Your cousin shouldn''t have any problems! The 30 day waiting period was from the day the Supreme Court announced the ruling [May 15th] until the ruling took effect and people could get married [June 16th for most people]. There is now no waiting period for a civil ceremony, and if they are having a ceremony in CA the license is good for the same time period it would be for any other marriage, so just do the same thing you would do yourself. In CA there is NO residency requirement [they just lifted the residency requirement in MA, too!] so anyone can get a license. It will definitely be this way up until the election/prop 8 voting in Nov. so he is in the clear there. The only reason they would NOT want a license is if they already have one. Indiana doesn''t have any sort of protections for same sex couples as far as I know, but if they were to already have a marriage license or domestic partnership registered anywhere in the world, getting another marriage license would potentially invalidate the other ones. It''s a total gray area, though... no one knows for sure what would happen, but Lambda warns against it.

That was a huge help thanks! This will be their first marriage license. They will have a bigger spring wedding next year. My cousin''s dream was always to get married on a beach. Since our house has a private beach we''ll be able to treck down their and do a quick ceremony. It adds a teeny bit of stress to plan two weddings but it''s worth it. He''s pretty much the only real ''brother'' I''ve got. His birthday is the day after mine so we thought it would be perfect to do his wedding the day after too!

We were so lucky timing-wise that he''d be out here and can legally get married to his partner in CA. I told him he couldn''t pass up the opportunity!

I heard somewhere that New York doesn''t allow gay marriage but they recognize it f you were married elsewhere, is that true? I wish he could just move out here. You should have seen it when he lived in Kentucky, oy vey!

Getting married on the beach sounds so beautiful and fun. I''m so glad he and his fiance are able to live out that dream, and how sweet of you to help them plan it so close to your own wedding! It is really great timing, and a wonderful opportunity for anyone who can make it out to CA before Nov. and hopefully after as well! A girl can dream!

You heard right about New York: They now recognize same sex marriages but won''t perform them there. It''s a very arbitrary rule, but the fastest way that governor Paterson [now governor since Spitzer resigned] could implement it. They will most likely be passing more comprehensive legislation soon. There is quite a bit of opposition to both recognizing and performing same sex marriages in NY, but I am pretty sure their legislature is going to leave it as-is [can recognize but not perform the marriages] until after the Nov. election. NY''s legislature is expected to slide pretty far toward the Democratic side this fall, and it''s very likely that they will just end up allowing the marriages. It''s SUPER bad for their economy to have all the marriages performed out of state, especially with MA and Canada pretty nearby and CA being such a beautiful destination area. Oh right, and it''s also rather silly in general and violates equal protection laws.
