I''m a Senior Citizen and I made reservations a few weeks ago for 2
rooms for 3 days at the local Super 8 Motel in McKinney, TX for the
use of 3 of my daughters coming in for a birthday visit on July 28th.
I made the reservations through Orbitz., and they required me to pay
$324.00 for the rooms in advance. One of the traveling daughters has
since became deathly ill and has been in intensive care since July
2nd, and it appears the visit the other daughters will also be
cancelled. Upon reviewing my reservation through Orbitz, I find there
is a 100% cancellation penalty if the reservation is cancelled. I
visited the local Super 8 and they confirm it is their policy to not
refund any portion of the reservation if it is cancelled. They say
that if I had made the reservation directly with them, I would not
have been charged in advance, and there would be no penalty to cancel
it. Their policy is very unfair to me. If I had made it direct with
Super 8, they would receive no money in the event of cancellation -
but since I made the reservation through Orbitz, they get to keep my
$324.00 and provide no service. I''m wondering if I have any legal
recourse?
