Lindsay Lohan is suing the financial company E-Trade, insisting that a boyfriend-stealing, "milkaholic" baby in its latest commercial -- who happens to be named Lindsay -- was modeled after her. And she wants $100 million for her pain and suffering, The Post has learned.

The actress filed a lawsuit yesterday in Nassau County Supreme Court over the commercial that debuted during the Super Bowl this year.

The ad -- part of a series starring babies who play the stock market -- features a boy apologizing to his girlfriend via video chat for not calling her the night before.

"And that milkaholic Lindsay wasn''t over?" the baby girl asks him suspiciously.

"Lindsay?" the boy replies, just before a baby girl sticks her head into the frame and slurs, "Milk-a-what?"

Lohan''s lawyer, Stephanie Ovadia, said the actress has the same single-name recognition as Oprah or Madonna.

"Many celebrities are known by one name only, and E-Trade is using that knowledge to profit," Ovadia said.

I''ve known people named Lindsay. It was in the top 50 girls'' names in the 80''s according to the baby name wizard. (Addictive site, btw.) I have NEVER known anyone named Madonna or Oprah. Oprah''s name is a misspelling of Orpah, so of course it''s unique. Kind of a crazy argument they''re trying to make.

However, when I read the title of this thread, Lohan was the first Lindsey that popped into my head for some reason. What's even funnier (or sadder?) is that by implication she is stating that she is "known" for being a "milkaholic" aka alcoholic (the baby "slurs" her words).

If this WAS supposed to be Lilo (and come on, it's insane to even claim it is, which makes me question her legal team), but WHY would you own up to it? Her claim is that they are "trading" on her name and reputation as a drunk girl who steals boyfriends?????????????

The logic astounds me.

LOL I just read this before having coffee (a mistake to do anything pre-coffee and thought, "OMG LOHAN IS PREGGERS!!!!" Ha. My sleepy brain...

As for the lawsuit, as an attorney Ovadia has an obligation not to file frivolous lawsuits. I think this falls squarely into that category - a huge waste of the court''s time.

BTW I looooooove me some baby e-trade commervials!
