So I bought a vintage Hamilton watch off of eBay. The many photos in the listing depicted a watch with the word "Hamilton" on the face. I received the watch today, and somehow the watch now says "Lady Elgin." I think I've been duped. Do I have any recourse? The listing describes the brand as Hamilton. Is it still a Hamilton watch if they switched the face out?

I have contacted the seller and am waiting for a response. I don't believe I should have to pay return shipping, as the watch I received was not the same as the one in the photos. Argh! Anyone have experience like this? I am prepared to leave negative feedback if they are resistant (though I have never done this before)!

I haven't done this myself, but perhaps you could file a complaint through ebay?

Definitely try to deal with the seller first. Either they sent you the wrong watch or they didn't put the right picture in the listing. They should take it back. Did they have really good feedback?

I have never done it either. I'm going to see what the seller says about it, but I'm not sure I even have a case.

I guess I assumed it was malicious, but it might not have been. They had 99.something% positive, with very few negatives and neutrals thrown in there.

ETA: Thanks for the responses. I guess I'm mostly just bummed because I liked the watch so much, but the price I paid probably reflects the Hamilton name versus a no-name antique watch.

Ebay protection is specifically for this, that a listing has to sell what it says its selling.

Send an email to the seller--ONLY through the ebay system, not a regular email-- and explain gently, but firmly, that the watch was misrepresented and you are intending to file a claim.

When you send it back--only if the seller says to do so-- follow his instructions EXACTLY. Insure it for the full amount, and send it with tracking, signature required, even if he says not to. You don't want him claiming he never got it back.

You have 30 days to successfully file a claim, so don't let the days slip by.

This kind of stuff ticks me off, I sell on ebay, and these types of sellers give the rest of us a bad name. :|

Thank you so much, iLander, for the information. I've never returned an eBay item before. Is there a way to ask to not pay for return shipping? Or is that just a cost I'm going to have to eat for doing business online?

It may be a mistake, as in the wrong watch shipped to the wrong person. Uh oh . . . someone else may have Your watch . . .

Go to: http://ocs.ebay.com/ws/eBayISAPI.dll?CustomerSupport

Open a "item not as described" case.

You should be able to get reimbursement for shipping costs.

Be sure to respond to all emails related to the case in a timely fashion.

ETA: THis thread might be helpful:

I'm going to wait until Monday to open a case. They had previously told me that they aren't around during the weekends, so I'm going to give them the benefit of the doubt. That thread was very helpful, thank you so much!

The watch is very unique, I can't imagine there are two of the same watch with different brands (with the same watch band of a different brand of watch and a unique color). I do hope it was an honest mistake!

I'm so sorry you're having to deal with this. I was duped a few yrs ago- same scenario basically, and Ebay did absolutely nothing to help me. It's exactly the reason I don't use the site anymore :((

That's awful :nono: . I'm sorry they didn't help you at all! Ugh. I think eBay has changed a lot recently to protect the buyer.
