Very upset after being scammed by trusted jeweler...advice please!!

Hi all...just looking for a place to vent and perhaps get some advice.

On our 5 yr anniversary last month, my husband and I returned to the same jeweler where we purchased our wedding bands. We wanted to get my engagement ring and eternity band polished, as well as see about purchasing a 2nd eternity band. My wedding band is a 1 carat, channel set, white gold band with 29 stones. We inquired about getting this band re-set at a larger size (from a 4.5 to a 5) and the owner told us it would be easier to just shave off some of the metal from the inside and it wouldn't be noticeable at all. A few of the stones were loose and were sliding back and forth as well.

The owner said he would clean up the band, tighten the stones, size it up to a 5, as well as create a duplicate 1.0 ctw band for us. He charged us $40 for the maintenance of the original band, plus $695 for the new band.

After wearing the new band for THREE WEEKS, I looked down and discovered a stone had fallen out. My original band also already had loose stones again. They had shaved off too much from the original band and now it was very thin and weak looking. My husband took both back to the jeweler, and the owner was very rude and mocked him. When my husband told him that I was 8 months pregnant and NOT hard on my hands, he held up both hands in the air and said "What, does she walk around like THIS all day?" Another employee at the shop commented on my original band, saying it was too weak now and should be re-set...after they were the ones who recommended shaving it down!

This isn't even the worst part. They finally agreed to replace the stone for free, but of course charged us another $45 for labor. After picking up the new band AGAIN, I took it to 2 other recommended jewelers in the area. The first jeweler right away said "This is not 1 carat." Both jewelers inspected the bands with a loop and commented that the metal on the band was so thin, it was barely holding the stones in. In other words, the eternity bands were poorly constructed, stones were overlapping, inconsistent gaps, etc.

I had one jeweler remove all the stones from the new band and they only weighed .77 total carats. NOT 1.0 as indicated on my receipt.

I know I should have gone right back to the original jeweler and demand an explanation but I didn't have the energy to deal with their attitudes and rudeness, especially being 8 mths pregnant. I ended up asking the 2nd jeweler to just re-set BOTH bands because I didn't want to have to deal with more stones falling out in the future.

Now, I know it is too late to go back and demand a refund (They refuse refunds anyway) but I'm wondering what is the best way to let the jeweler know that i know they scammed us? Write a letter? call? what would you do?

BTW, i live in Los Angeles, and the jeweler is in the downtown jewelry district...

I would definitely report them to the BBB. So sorry about your experience. Have you gotten your rings independently appraised? that way you would have more backup and evidence when you report to the BBB and did you pay with credit card? if you did, and your information on the sales receipt is incorrect, then I would try and work with the credit card and get a refund as well if they will.
 
dkim1228 -- poor thing. I''m so sorry to hear that you''ve had to deal with this, ESPECIALLY since you''re 8 months pregnant (congrats, btw)! These situations are the worst because you feel so powerless. It seems like talking with this jeweler isn''t getting you anywhere, so I''d file a complaint with the Better Business Bureau. They will work to mediate between the consumer and the business to arrive at a reasonable solution. Hope this helps!
 
Name the store so that at least others who do a search will not got to that jeweler.

Both the bands are with the new jeweler now, getting re-set. I probably should have gone through the BBB and gotten them appraised before getting them re-set now....but I just wanted them to be fixed asap and not have to think about it anymore!

I wonder if I can still file a claim with my credit card company and the BBB even though I''m getting them altered?
 
Definitely take whatever action you can. File the credit card claim, that way you have someone else fighting on your side. File a claim with the BBB, though they will probably want to see what steps were taken to resolve the issure prior to filing. I''d also report the jeweler to the Jeweler''s Vigilance Committee. Claiming a 1ct total weight band and only using .77ct is not a small mistake. The worst any of them can say is there is nothing they can do.
 
this sounds very stressful, especially with a baby due in a month, which is the important thing. I would report them to the BBB, but then I would wipe it out of your mind. Some of these things are going to happen to all of us during the course of our lifetime. Just live and learn and move on. I don't think you'll get any satisfaction from the store based on their ridiculous behavior. Sorry you're having to deal with this. One way or another we've all been there.

Good grief, this is one of the worst stories I''ve ever heard. Don''t worry, I''m sure your credit card company will accept a chargeback (especially if you paid with an American Express -- they are sharks), if you did indeed pay the jeweler with a credit card.

Congratulations on the baby, and I hope you have a safe and quick delivery. Try not to stress too much over this situation, although I empathize with how awful it is!
 
I''m sorry to hear about your terrible experience! That is just terrible!

I agree with everyone else about reporting them to BBB and other sources. If your credit card company was part of the purchase get them involved too.

Other than that, I would recommend you tell EVERYONE who mentions jewelry about how badly you were cheated.

I have a friend who dealt with a company that charged him 400.00 do clean and service a watch. When it didn''t work properly afterwards he took it to another jeweler who identified it had in-fact not been cleaned or serviced. He reported them to the watch manufacturer, who didn''t do anything.

I don''t think the Jewelers 400.00 scam was worth 15-25k in lost business.

Word of mouth is VERY POWERFUL!

I have to agree with these sentiments. You have much better things coming in your life and we all pay what I call "stupid tax" from time to time from any number of situations. Not saying you were stupid here - you said you had a previous relationship with the jeweler and perhaps the tough economy made them rabid?

I would first seek the inner peace by letting the money go and consider it gone and not coming back. If I happened to get all or some of the money back then so much the better.
Second, I would keep doing what you are doing now and notifying people on every review forum in the area. Sometimes merchants give in just to clear their name. In any event if they loose potential sales from it then they end up loosing more than they cheated you for.

I would DEFINITELY file a complaint with my cc company. Even if you don''t get the charges reversed in the end it will be on record with Visa, MC, etc., which are nationwide/international, that this vendor has such business practices. Just think if ten people before you have filed complaints on this same company they might reverse the charges no further questions asked

Unfortunately, in the end, if you no longer have the actual pieces of jewelry to return to them, that will likely put your chances at refund to slim and none here. So without letting it take over your life, just for fun, I would send every shot across their bow I could just because they deserve it.

Personally, AFTER the baby is born and when you feel you can handle stress again, I would contact the City and State Attorney General''s office and file a formal complaint. I would also ask the current jeweler to write a report as to the condition of the rings when received and the total weight of the diamonds when removed from the rings. Be sure to take those with you to the Attorney General''s office. If possible, keep the original mountings as proof of their poor quality.

They may tell you that it is too late to do anything, so do not be too surprised. Just ask them to keep your records on file to compare against the other complaints that are sure to follow.

You might also consider contacting one of the TV or radio stations that host a "6 on your side" type program. If it is a slow news week it is very possible that one of the reporter barracudas will latch onto those bozos and give them a stiff case of "I wish I hadn''t done that!"

More important though is this.

Go to your quiet place and find peace. This kind of stress is NOT good for you or for the baby. While I agree that you have been egregiously wronged, I pray for you to realize that these are things and that you are also responsible for how you respond to this and that responding too urgently can be bad for your health. There are many good people in my industry, and unfortunately there are also many bad people. It sounds as if you have now found some of the good jewelers and I hope you let the beauty of your new and properly made rings be what you hold on to in this time.

SO sorry for your frustrations. I would ask both jewelers that viewed the band for an affidavit of their statements and file a claim with small claims court. I also agree with filing a claim with the BBB and the CC company.
