The Fairness Hearing was held on April 14, 2008, and the Court approved the Settlement on May 27, 2008. Appeals were subsequently filed contesting final approval of the Settlement. A hearing on these appeals was held on January 28, 2010, at the Third Circuit Court of Appeals in Philadelphia. On July 13, 2010, the appeals court sent the settlement back to a lower court for further consideration. Click here for the opinion. The Court issued an order on August 30, 2010 granting the petition for rehearing en banc. The panel opinion is vacated. The court will set the matter for oral argument en banc.

(EN BANC definition:
Fr. "by the full court" "in the bench" or "full bench." When all the members of an appellate court hear an argument, they are sitting en banc. Refers to court sessions with the entire membership of a court participating rather than the usual quorum. U.S. courts of appeals usually sit in panels of three judges, but may expand to a larger number in certain cases. They are then said to be sitting en banc.)

Don't spend your 29 cents until it's paid.

Didn't see the link in your post, but from your description DeBeers won its appeal and the case will be reheard by the US court of appeals. :nono:

Hi, Chunkycushion lover! I wasn't sure if I was allowed to post the link here. If you google DeBeers Lawsuit, you can get a link to the actual opinion.
