Again, the Sarasota address is not an office. It doesn’t exist and there are no employees.

It is a freight forwarder. The “suite” is his account number with the warehouse forwarder.

it is for the ease of customers to be able to send back gems within the USA and then they are forwarded to Ed in Europe.

Ed has no offices in the United States.

The website domain server is located in Texas.

Which is why all the court and BBB nonsense is a useless endeavor. OP should be dealing directly with his CC company and/or PP.

I'm going to ignore all the rudeness and make some general observations:

Finding an unheated yellow sapphire that is eye clean to a fussy eye (I have an extremely fussy eye I see inclusions other people don't see) in that price range is possible, finding a 100% loupe clean unheated yellow sapphire in that price range - needle in a haystack. I wouldn't like to be set that task and I have access to a number of Sril Lankan and Asian gemstone dealers.

In order to make sapphires "loupe clean" mostly they are heated, some come naturally that way but they generally will cost way more than the OPs budget.

Next point, one of my dear PS friends had a bad experience with Ed too, I'm not a big fan of his photoshopped photos or of the way he markets ethically sourced stone costing more money. I try and source everything "ethically" that doesn't mean I charge anyone more money for that.

On the flip side of that, his site has clear return policies it says if it's a standard item off his website you get a full refund, if it's a custom order which it was in this case that is his return policy. Do I personally agree with that amount for those stones regardless of how much time it took him to find them? No - I don't BUT ALL return policies SHOULD have been clearly outlined to you the purchaser before you purchased the stones.

That's the issue here - what are the return policies and did you fully understand them when you purchased the two items.

Because you clearly are fussy about what you want, advise for future purchases do NOT purchase anything that doesn't have a 100% return policy or something that you cannot inspect or see with such a policy. Not every vendor gives a 100% return policy and that's O.K, it's just a matter of everyone clearly understanding that.

So far from the truth. In fact, I specifically told him it looks like inclusions but he said not to the naked eye. Only with magnification. Etc. Multiple times I questioned him, he responded that it was in fact eye clean.

White wave. Such a clairvoyant.. Wasting money on dead stones.. :lol::lol::lol:

In great detail I laid out my specifics.
They were agreed by vendor.
He did not deliver said specifics.
I sent a bankwire. I trusted him because I trusted pricescope.
I am here so others can hear my story.

The image of the coral you showed was taken by Ed. It is magnified (unless the coral is magically enormous). You said you okayed it. And Ed said you cant find coral that's clean under magnification. So you showing us a magnified picture that you accepted doesn't help your position.

Plus the continued racism/bizzare monkey theories.

Wow. So, to summarize, you bought something and had an unpleasant experience, which you wanted to share. People questioned you about it. You got defensive and it went downhill fast and off the rails after that. Got it!

People here are very helpful, and a lot gets lost on a message board. You can't see body language or hear their tone. People are different, from different cultures, etc. Message boards are a collection of personalities and temperaments. Just let it go now. Nothing good can come of continuing this thread. You will have to work it out with Ed. None of us can really help with that.

I just want the time back that I spent reading all this.

@Star, if you paid by bankwire then, according to my quick research anyway, I don't think you really have much recourse here but to accept the 2/3 refund or just keep the stones. Sorry it didn't work out for you.

I'm not passing judgement one way or the other, as I have no clue what discourse went on between you and Ed. So you very well may be entitled to a full refund.

But even if you are in the right in this situation and take it to small claims court, good luck ever seeing the money again if you paid by wire. Ed is located in Germany. As already mentioned, it is usually a major PITA to get someone to pay up on a small claims settlement even if the person is located in a different state, let alone a different country. Sure, he has an LLC in America for shipping purposes, but that means pretty much nothing. He is physically located in the EU.

As mentioned by @seaurchin, if you take this to small claims court, you're going to be sinking MUCH more money into this case than the $2k that you would lose by accepting the 2/3 return. And even if you win, it's very likely that you won't see ANY of that $9k in the form of a refund. You can sit here all day long with a high and righteous attitude of "I am right and I will PROVE that I'm right," but IMO, it doesn't make a darn bit of difference if you end up incurring huge losses in court just to prove to yourself that you were right.

If you are in the right here (meaning that Ed NEVER mentioned that this loose sapphire would be subject to a 2/3 cost return policy) then I do truly feel sorry for you. But I hope you use this experience as a valuable lesson to always pay with PayPal and/or credit card when purchasing from any internet vendor for the first time due to the inherent protections that these purchase methods afford to consumers. Personally, I always use my Visa Signature card when purchasing from an online vendor for the first time no matter how stellar their reputation is on some random online community, message board, or review site like Yelp. Call me overly cautious, but an online vendor needs to gain my personal trust over the course of multiple problem-free transactions before I would ever consider wiring them money. I would suggest you take the same approach from here on out.

I will also take the advice to heart about not wiring money. I recently bought an expensive piece of jewelry and felt like I was being lazy not to bother with wiring the money, since a nice little discount was offered for it. Didn't even think about possible problems with refunds.

Yeah, can we knock it off with the blood stuff, please? I'm all for cultural relativism when it doesn't insult MY culture, which says that people are people and different blood types does not mean we are different species.

(Sidebar: how would we reproduce so successfully as to overpopulate our planet if a bunch of us were a different species altogether? Don't answer that; it's rhetorical.)

That story sounded familiar so I looked it up and re-read it. Now I remember we read it in one of my high school English classes. It haunted me then and it will be haunting me again!

Small claims courts are only about $100 as far as I've read.
PayPal for sure from now on.
Even if Ed offered me full refund, I'm absolutely terrified to send the stones back first as shady as this whole ordeal has been.
I do have a lawyer who's my friend. Yea he told me zip it up on here about certain things.
But on the note of receiving refund. That's a scary topic alone. The vendor has proven, after saying one thing but producing another, that he can't be trusted.
According to the lawyer, absolutely do not send those stones back without the money being in your account first. o_O

As far as going to court. Well, I'm not so concerned about the costs at this point. Or receiving the money back. Its all about principle. Ed is an online guy. After the way he's treated me, I would spend 2,000 so everyone can know, with an official court ruling, how he's sent me stones other than what we agreed to and has decided to incur those costs upon me.
And surely post that on every site I know.

Good luck with that! For the same reasons you have limited recourse given the jurisdictional aspects, I’d bet he is inclined to feel the same way about sending you a refund and just trusting you to send the stones back, especially after all that has been said & transpired. Any vendor will tell you they need the stones back in hand first to be confirmed they are what was provided and are undamaged before any refund would be given.

Yup. I've never been given a refund until the stones were back with the vendor and determined to be undamaged. And thats with good friendly transactions where no arguments or issues have occurred!

You are making yourself appear the bad guy here. And FYI your tone is starting to take a turn into appearing threatening ... maybe you should take your attorney’s advice, stop posting on here, and focus on whatever steps your attorney advises to resolve the matter.

My thoughts exactly. Come on, seriously? "Your time will come too. It is all written..."? This is starting to cross into the realm of some creepy, occult, dark-force-worshipping-casting-curses-on-people sh!t. Either that, or they are actually threatening someone with physical bodily harm. Either way, not cool.

I would highly recommend taking @the_mother_thing's and your lawyer's advice @StarRHnegative. If you want any chance of going anywhere with the lawsuit, just stop posting ASAP. You do know that this is a public forum, right? And you know how the internet works, right? There's nothing stopping Ed from accessing this thread and presenting it to the court system. Not that you've said anything damning regarding the return policy that you agreed to with Ed, but acting like a crazy person making weirdly-veiled threats to random strangers doesn't exactly paint you in a good light in the eyes of a court of law...

I seriously have no idea what you're talking about, OP. But threatening me doesn't help your case or make you look more right. It just reinforces the idea that you aren't being honest with us or yourself about the actual sequence of events. Even if you take this to court, it's highly unlikely that anything will work in your favor. Or that you'll get money back. Or that any judge will issue something saying, " OP IS RIGHT!" that isn't how the court system works. And going around posting outlandish things means Ed can use this stuff to counter sue you for slander/libel.
